Definitions

  1. "MIMCOLLECTIVE" means the Mimco loyalty program providing members with access to exclusive benefits and rewards.
  2. "Activation/Activate" refers to the process required to activate the MIMCOLLECTIVE card on the member website.
  3. "Benefits" means any benefits given to the members.
  4. "Member" means individuals who sign up to the MIMCOLLECTIVE.
  5. "Member Profile" means the personal details of the member which can be updated on the member website.
  6. "Member Website" refers to the website mip.mimco.com.au where details of the Mimco loyalty program (including the most up to date Terms and Conditions) can be found. The member website also provides for the facility to activate the MIMCOLLECTIVE card and update the member profile.
  7. "Mimco" means Mimco Pty Ltd ABN 13 067 573 291 or its authorised representatives.
  8. "MIP card" refers to the membership card that is linked to the members' profile on the member website.
  9. "MIP" means Mimco Important Person.
  10. "Redeem rewards" means members can redeem rewards against purchases.
  11. "Rewards" refers to rewards given to members as a consequence of purchasing behaviours, incentives and/or promotions. Members are notified of rewards via email.
  12. "Technical Issues" means the technical malfunction of any telephone network, connection or lines, computer on line systems, servers, or providers, computer equipment, software, technical problems or traffic congestion on the internet or at any web site or intranet site.
  13. "Terms and Conditions" mean the Terms and Conditions set out in this agreement and as updated on the member website.

Terms & Conditions

  1. The Terms and Conditions set out in this document concern the operation of the Mimco loyalty program (the MIMCOLLECTIVE), the use of the MIP card, the member website and any promotional activity and loyalty transactions that arise as a consequence of the Mimco loyalty program.
  2. Individuals who join the Mimco loyalty program and/or redeem rewards agree to be legally bound by the Terms and Conditions.
  3. The most current Terms and Conditions at any point in time can be found on the MIP page of the Mimco website.
  4. The Terms and Conditions may be modified at any time without prior notification by Mimco in its absolute discretion. Despite anything to the contrary contained in this document, any modification to the Terms and Conditions may be applicable to a member retrospectively.
  5. Mimco will not accept any liability for any email communication to any member that is misdirected, lost or not received.
  6. Mimco will not accept any liability for any Technical Issues that may cause damage to any computer related to or used in connection with the Mimco loyalty program.
  7. Mimco may collect personal information from the members for the purpose of facilitating the Mimco loyalty program. Please see Mimco's Australian or United Kingdom Privacy Policy for more information.
  8. In its absolute discretion, Mimco reserves the right to cancel, terminate, modify or suspend the Mimco loyalty program at any time.
  9. Mimco will not be liable for any tax liability incurred by a member in connection with the Mimco loyalty program, including that incurred in the provision of rewards.
  10. The Terms and Conditions are to be read in conjunction with any additional conditions associated with rewards. In the event of any discrepancies, Mimco's decision in its absolute discretion will be final and binding.
  11. Mimco's decision in relation to all matters arising in relation to the Mimco loyalty program is final and binding.

Members | Membership

  1. An individual is deemed to be a member of the Mimco loyalty program when they sign up on the member website and activate their MIP card.
  2. Activation of the MIP card is deemed acceptance by the member of the Terms and Conditions.
  3. Membership of the Mimco loyalty program is only open to individuals with a valid email address.
  4. At any time, members can only have one membership to the Mimco loyalty program and one corresponding MIP card per region.
  5. Mimco reserves the right to refuse or terminate membership of the Mimco loyalty program without prior notice or reason and in its absolute discretion.
  6. Membership is not transferable.
  7. It is the responsibility of the member to update their membership profile.
  8. A member can at anytime terminate their membership by providing written notice to Mimco.

Card

  1. The MIP card remains the property of Mimco at all times.
  2. One MIP card will be issued per member.
  3. You must have a valid and unique email address in order to activate your MIP card.
  4. A current MIP card must be presented by the individual associated with the MIP card for all transactions including (but not limited to) requests for discounts, recording of purchases, redeeming rewards or in response to any promotional activity specific to the Mimco loyalty program.
  5. Members may be required to provide photo identification to verify their identity.
  6. Only one MIP card can be presented for each transaction.
  7. Members must notify Mimco immediately if the MIP card is lost, stolen or misplaced and until such time, Mimco will not be held responsible or liable for any authorised or unauthorised transactions.

Benefits

  1. Members of the Mimco loyalty program will be entitled to receive benefits.
  2. Mimco reserves the right to vary and cancel upcoming and existing benefits at any time and without notice.
  3. Free shipping is as stated within the terms and conditions of the relevant promotion.

Rewards

  1. At its sole discretion, Mimco may update a member account with a reward as a consequence of a purchasing behaviour, incentive and/or promotional activities.
  2. Mimco will notify the member via email of their entitlement to any rewards.
  3. Mimco reserves the right to withdraw, cancel or vary the rewards without notice and at any time.
  4. Rewards are generally expressed in a monetary form - for example, a $30 reward. However, in no way do rewards represent legal tender in any country.
  5. Rewards cannot be sold, transferred or assigned and are not redeemable for cash or any other like instruments - including (but not limited to) gift vouchers, gift cards, cheques and credit notes.
  6. Rewards can only been redeemed at Mimco stores (excluding Clearance) in Australia, New Zealand, Singapore, and the United Kingdom (excluding David Jones, House of Fraser and Smith and Caughey's department stores and other non-participating retailers) and can only be redeemed on presentation of the MIP card and corresponding photo identification.
  7. The currency in which rewards are redeemed will be based on the location of the redeeming store. For example, a store based in New Zealand will redeem the rewards in NZD. The Mimco online store is based in Australia and consequently, will redeem rewards in AUD.
  8. Despite clause 7 above and for the avoidance of doubt, rewards can only be earned or redeemed in the country of membership origin. For example, if a customer joins the Mimco loyalty program in Australia, rewards can only be redeemed in Australian stores.
  9. Mimco reserves the right in its absolute discretion to exclude certain items and promotions from being redeemed using rewards.
  10. If a membership is terminated from the Mimco loyalty program, all outstanding and future rewards will no longer be valid and will be rendered null and void.
  11. Rewards can take up to 48 hours before they are available for redemption.
  12. All rewards have an expiry date and at which point they will no longer be available for redemption.
  13. Only rewards from one MIP card can be presented per transaction.
  14. Mimco will not be held responsible or liable if rewards are not able to be redeemed for whatever reason but specifically, in the case of a technical failure of software or hardware or an EFTPOS malfunction.
  15. Rewards cannot be redeemed as payment for any part of a layby purchase.
  16. All rewards expire at midnight on 30 June of each year, regardless of when they are acquired.
